AILAIKIT DIGITAL SOLUTIONS

1. Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and Ailaikit Digital Solutions, a member of JEMZ Enterprises ("we", "us", "our"), operating in the Republic of South Africa.

By creating an account or using any Ailaikit service, you agree to be bound by these Terms. If you do not agree, please do not use the service.

2. The Service

Ailaikit Digital Solutions provides AI-powered digital tools, consulting services, website hosting, and automation solutions for small and medium enterprises (SMEs) and educational institutions. Our services include:

• AI-powered website creation, hosting, and management.
• Web hosting packages (Starter, Business, and Professional tiers) with cPanel access and Sitejet AI website generation.
• Digital consulting, AI implementation support, and staff training.
• Automated business systems, invoicing tools, and workflow automation.
• WhatsApp-based AI agents and communication tools.

3. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract to use our services. By using our services, you represent and warrant that you meet these requirements.

4. Account Registration

To access certain features, you may need to register for an account. You agree to:

• Provide accurate and complete information during registration.
• Keep your login credentials confidential.
• Notify us immediately of any unauthorised use of your account.
• Accept responsibility for all activities that occur under your account.

5. Fees and Payment

Certain services are subject to subscription or once-off fees. By subscribing to a paid plan, you agree to:

• Pay all applicable fees as outlined in the selected pricing plan.
• Provide valid payment information.
• Authorise recurring charges where applicable.

All fees are quoted in South African Rand (ZAR) unless otherwise stated. Prices are subject to change with reasonable notice.

6. Refund Policy

We offer refunds under the following conditions:

• If a service has not been rendered or activated, a full refund may be requested within 7 days of payment.
• Once a website has been generated or a hosting account activated, refunds are not available for that billing period.
• Consulting and training services are non-refundable once delivered.

7. Acceptable Use

You agree not to use our services to:

• Violate any applicable South African or international law or regulation.
• Infringe on the intellectual property rights of others.
• Distribute spam, malware, or harmful content.
• Impersonate any individual or organisation.
• Conduct fraudulent activities or collect user data without consent.
• Engage in activities that disrupt or damage our infrastructure.

We reserve the right to suspend or terminate accounts found in violation of these terms without prior notice.

8. Intellectual Property

All content, tools, branding, and technology provided by Ailaikit Digital Solutions remain the intellectual property of Ailaikit Digital Solutions and JEMZ Enterprises unless explicitly stated otherwise.

Content you create using our tools (e.g., generated websites) remains yours. However, you grant us a non-exclusive licence to display and host your content as part of service delivery.

9. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. By using our services, you consent to the collection and processing of your personal data in accordance with the Protection of Personal Information Act (POPIA), No. 4 of 2013.

10. Third-Party Services

Our platform may integrate with or link to third-party services (e.g., payment gateways, AI providers, hosting partners). We are not responsible for the practices or content of these third parties. Use of third-party services is subject to their own terms and conditions.

11. Disclaimer of Warranties

Our services are provided "as is" and "as available." We do not warrant that:

• The service will be uninterrupted or error-free.
• Results from AI-generated content will meet specific expectations.
• All information provided through the service is accurate or complete.

We disclaim all warranties, express or implied, to the fullest extent permitted by law.

12. Limitation of Liability

To the maximum extent permitted by South African law, Ailaikit Digital Solutions and JEMZ Enterprises shall not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to your use of the service, including but not limited to loss of data, loss of revenue, or reputational harm.

Our total liability for any claim shall not exceed the amount paid by you in the 30 days preceding the claim.

13. Termination

Either party may terminate this agreement at any time. Upon termination:

• Your access to the service will be revoked.
• Data associated with your account may be deleted after a 30-day grace period.
• Outstanding fees remain payable.

We reserve the right to terminate accounts without notice in cases of serious violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be resolved in the courts of South Africa, with jurisdiction in the Gauteng Division.

15. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be communicated via email or a notice on our platform. Continued use of the service after changes constitutes acceptance of the updated Terms.
